Privacy notice

Who collects your personal data?

MOLSAM ADVISORY GROUP, S.A. de C.V. («MOLSAM»), with address at Calle Louisiana 80, Colonia Nápoles, Mexico City, Mexico, is the controller of the personal data you (the «Data Subject») provide to us.

This Privacy Notice sets out the terms on which MOLSAM collects, uses, stores and protects your personal data, in accordance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and applicable regulations.

What data do we process?

• Identification data (name, age, sex, address, signature, photograph, nationality).
• Contact data (personal and work telephone, email address).
• Employment data (position, department, work address).
• Tax and financial data (tax ID, account or card number, banking details).
• Biometric data (fingerprint, image) in premises with access controls.

Purposes

Primary purposes

• Entering into contracts and providing advisory, consulting or specialised services.
• Internal administration, invoicing, collections and performance of contractual obligations.
• Responding to requests from competent authorities.
• Security and access control at our offices.
• Compliance with legal and regulatory obligations in Mexico or abroad.

Secondary purposes

With your consent, MOLSAM may use your data for:

• Sending information about products, services or events.
• Promotions, satisfaction surveys, quality assessments and market research.
• Newsletters and informational or commercial campaigns.
• Loyalty and benefit programmes.

You may object to these secondary purposes by writing to admin@molsamadvisory.com. If you do not object within 5 business days of the collection of your data, consent will be understood as given.

Video recording and photographs on our premises

When you enter MOLSAM’s offices your image may be captured by video surveillance cameras, exclusively for security, incident prevention, access control and the protection of staff, visitors and company property.

Who we share it with

MOLSAM does not sell, rent or trade your personal data. We may share it with:

• Affiliates, subsidiaries or companies within the same corporate group.
• Service providers engaged to perform contractual or legal obligations.
• Competent authorities that lawfully require it.

In every case we enter into the agreements necessary to safeguard confidentiality and the proper processing of the data in accordance with this notice.

Specific transfers

In order to fulfil the purposes described above, MOLSAM discloses personal data to the following recipients:

• Mexican Institute of Industrial Property (IMPI): filing and prosecution of applications and submissions. Transfer necessary to perform the engagement and required by law.
• Payment processors (Clip and PayPal): processing payment for the service engaged. Transfer necessary to maintain the legal relationship.
• Web analytics provider (Google Analytics): measuring use of the Site through online identifiers. Subject to acceptance of the cookie notice.
• Email and hosting providers: sending communications and storing information.

Some of these providers may process the information outside Mexico. With the exception of web analytics, the transfers listed above do not require the data subject's consent. MOLSAM does not sell or assign personal data for purposes other than those stated here.

Sensitive personal data

MOLSAM does not collect sensitive personal data through the Site. The available forms request only name, email address, telephone number and information relating to the distinctive sign or the matter on which advice is sought.

Your ARCO rights

You have the right to Access, Rectify, Cancel and Object to the processing of your personal data. To exercise them, send a request to admin@molsamadvisory.com or submit it at our address, including:

1. Your name and a means of contact.
2. Documents evidencing your identity or legal representation.
3. A clear description of the data concerned.
4. Any element that helps locate the data.

We will respond within a maximum of 20 business days and, where the request is well founded, give effect to it within the following 15 business days.

Limiting use or disclosure

You may ask to be added to our exclusion list to stop receiving promotional communications by writing to admin@molsamadvisory.com. You may also limit the use of cookies in your browser.

Data collected on our website

We may use cookies, web beacons and similar technologies to obtain information about your activity on our website, such as browser type, pages visited, IP address, operating system and access times. You may configure your browser to block or delete cookies, although this may affect how the site works.

Minors and persons with limited capacity

MOLSAM does not knowingly collect data from minors or persons under guardianship. If you believe we have obtained such data without the corresponding consent, contact us so we can delete it.

Changes to this notice

MOLSAM may amend or update this Notice to comply with new legal provisions, internal policies or the needs of the services offered. Any amendment will be published at www.molsamadvisory.com.
