You hold the client relationship. We handle Mexico — flat associate fees, direct contact with the attorney on the file, and reporting you can forward to your client without rewriting it.
Why a designation to Mexico needs local counsel
Mexico has been a party to the Madrid Protocol since 2013, and IMPI examines every designation on the merits. Four features of Mexican procedure catch foreign firms that try to handle a refusal from abroad.
Everything is filed in Spanish
Every application and every submission to IMPI must be in writing and in Spanish, and any document in another language must be accompanied by a translation (article 13 of the Mexican Industrial Property Law). A response drafted in English is not a response.
Notice is given by the Gazette, not by email
A notification takes legal effect on publication in the Industrial Property Gazette alone, independently of whether the courtesy notice was sent or received (article 20). If nobody is watching the Gazette for your file, the term runs anyway.
Two months, plus two more
IMPI grants two months to answer a requirement, an impediment or an opposition (article 225). A further two months is available automatically, with no request needed, provided the fee for the month of compliance is paid (article 226). Miss both terms, or fail to file proof of payment, and the application is deemed abandoned.
Amending the mark restarts the filing
If the mark is modified, or goods or services are added or substituted in order to overcome the impediment, the application becomes a new filing: new fee, fresh publication, and the filing date becomes the date of that new filing (article 227). The instinct to simply amend the specification can cost the priority date.
What we handle for you
Responses to IMPI provisional refusals and office actions, on Madrid Protocol designations and on direct national filings.
Address for service in Mexico and representation before IMPI, so notices reach someone who is watching the Gazette.
Direct national filings where a designation is not the better route, with Nice classification reviewed against Mexican examination practice.
Oppositions, and defenses against oppositions, within the one-month window following publication of the application.
Declarations of actual use, due within the three months following the third anniversary of the grant, and renewals.
Availability and conflict searches in MARCANET, including whether a blocking registration is still alive or has lapsed for want of a use declaration.
Infringement actions, cancellation and nullity proceedings, and customs border measures.
Translation of the documents the file requires.
How we work with foreign firms

You keep the client
We do not approach your client, before, during or after the matter. Reporting goes to you.
One attorney, not a queue
You correspond with the attorney who prepares the submission, with replies in under 24 business hours.
Reports you can forward
Written in English, with the ground and the article cited, so you can pass them to your client as they are.
Frequently asked
Can a foreign company own a Mexican trademark?
Yes. Foreign individuals and foreign companies can own a Mexican registration outright. What is required is a Mexican address for service, which we provide as your representatives, and a power of attorney in our favor. We send you the form and tell you exactly what formalities it needs.
How quickly can you take over a file with a running deadline?
The same business day, if you write to us with the international registration number or the Mexican file number. Terms expressed in months run date to date and include non-business days, and they start on the business day following the day the notification takes effect (article 21) — so the first thing we do is confirm the exact expiry against the Gazette.
Do you take instructions in English?
Yes. Our correspondence with you is in English; the filing itself is in Spanish, as the law requires.
What do you need from us to start?
The international registration or Mexican file number, a copy of the office action if you have it, and the applicant details as recorded. The power of attorney can follow.
Do you act against other firms’ clients?
We run a conflict check before accepting any instruction and tell you the same day if we cannot act.
Send us the file number
Tell us the international registration number or the Mexican file number and what the office action says. We come back with the deadline, the arguments available and a flat fee.
